Procurement of two traction transformers for Kassø substation

Yderligere oplysninger: General information on participation in the procurement procedure: Participation in the procurement can only take place electronically via Banedanmark’s electronic tendering system. In order to obtain access to the tender documents, the candidate must be registered or register as a user. ESPD and documentation: The candidate must submit an ESPD as its request for participation, as preliminary proof of the matters referred to in section 148(1)(i)-(iii) and section 137(1)(ii)-(iii) and (v) of the Danish Public Procurement Act, cf. sections 11 and 12 of Executive Order no. 1078 of 29 June 2022. It is not necessary for the candidate to sign its ESPD.

In the case of a group of economic operators, for example a consortium, a separate ESPD must be submitted for each participating economic operator, and each participant’s ESPD must be signed by that participant. It is not necessary for the lead candidate submitting the request to sign its ESPD. If the candidate relies on the capacities of other entities, an ESPD must be submitted for each of those entities, signed by the supporting entity.

Before the award decision, the tenderer to which Banedanmark intends to award the Contract must present documentation of the information provided in the ESPD in accordance with sections 151 to 152, cf. section 153, of the Danish Public Procurement Act, cf. section 12 of the Executive Order. Selection of candidates: Banedanmark will select the stated number of candidates in accordance with the selection criteria set out in this contract notice, unless no more than that number of compliant requests for participation are received. Estimated value, one contract: The amount stated is an estimate of the expected contract sum for the full term of the Contract.

The estimate comprises the contract sum for both Transformers including installation, an amount for price adjustment and an amount for changes and unforeseen matters. The procurement contains no options. Number of requests for participation: Each candidate may submit only one request for participation. Obtaining supplementary information: Banedanmark reserves the right to apply Article 76(4) of Directive 2014/25/EU and to request the economic operators to submit, supplement, clarify or complete information and documentation, in full compliance with the principles of equal treatment and transparency, see clause 6.5 of the tender specifications. Article 5k of Regulation no.

833/2014 as amended: Attention is drawn to the fact that the procurement is covered by Article 5k of Regulation (EU) no. 833/2014 as amended. The provision prohibits the award of contracts to Russian undertakings and Russian-controlled undertakings and others; see Article 5k(1) for the precise delimitation. Banedanmark reserves the right at any time during the procurement process to require documentation that the economic operators are not covered by the prohibition, for example by requiring a declaration to that effect or documentation of the operators’ and any subsuppliers’ place of establishment and ownership. See clause 1.1.4 of the tender specifications.

The Danish Investment Screening Act: Under the Danish Investment Screening Act, see Consolidated Act no. 1256 of 27 October 2023 as amended, economic operators which (i) are domiciled outside the EU or EFTA, or (ii) are controlled by or under significant influence, as defined in the Act, of an undertaking domiciled in or a national of a country outside the EU or EFTA, must apply to the Danish Business Authority for authorisation to enter into a special economic agreement within a particularly sensitive sector or activity. Banedanmark assesses that the conclusion of the Contract may be subject to a requirement for authorisation.

Candidates and tenderers are encouraged to clarify whether their conclusion of the Contract is subject to such a requirement. Further information is available at erhvervsstyrelsen.dk. See clause 1.1.5 of the tender specifications. Validity of tenders: The tenderer must abide by its initial tender and by its final tender for 90 calendar days from the relevant deadline for submission, see clauses 6.1 and 6.4 of the tender specifications.

Krav til tilbudsgiver:

The candidate’s shareholders’ equity for the last financial year available. The information is to be provided in part IV.B of the ESPD. It is a minimum requirement that the candidate’s shareholders’ equity for the last financial year available is equal to or greater than DKK 0. If the candidate relies on the capacities of other entities, or if the candidate is a group of economic operators, shareholders’ equity is calculated as a total amount for the participating entities for the last financial year available.

The candidate’s annual turnover for each of the three last financial years available. The information is to be provided in part IV.B of the ESPD. It is a minimum requirement that the candidate’s average annual turnover over the three last financial years available is at least DKK 15 million. The average is calculated as the sum of the annual turnover for the three years divided by three. If the candidate relies on the capacities of other entities, or if the candidate is a group of economic operators, the turnover is calculated as the sum for the participating entities for each of the three financial years.

Where the undertaking was set up or started trading less than three financial years before the deadline for submission of requests, the average is calculated over the financial years available.

The candidate’s solvency ratio for the last financial year available. The information is to be provided in part IV.B of the ESPD. It is a minimum requirement that the solvency ratio for the last financial year available is at least 15 %. The solvency ratio is calculated as shareholders’ equity divided by total assets at the end of the financial year, expressed as a percentage. If the candidate relies on the capacities of other entities, or if the candidate is a group of economic operators, the solvency ratio is calculated as the sum of the participating entities’ shareholders’ equity divided by the sum of their total assets.

Each entity must state its shareholders’ equity and its total assets in the ESPD.

The candidate’s most significant comparable references for the supply of traction transformers designed for two-phase connection, or of other power transformers designed for two-phase connection. The references are to be provided in part IV.C of the ESPD. References for supplies performed within the last ten years before the deadline for submission of requests are accepted, as transformers of the type tendered are supplied in small numbers and have a service life of several decades. The list may contain no more than five references, and each reference may be no longer than 2,400 characters. No minimum requirements are set as to technical and professional ability.

The references serve solely as the basis for the selection among the suitable candidates. If more than five compliant requests are received, Banedanmark selects the five candidates which have submitted the most relevant references.

In assessing relevance, weight is attached to the following, in the order stated: the comparability of the transformer supplied, where a reference concerning a traction transformer designed for two-phase connection is more relevant than a reference concerning another transformer designed for two-phase connection, which in turn is more relevant than a reference concerning a transformer of another type; then the scope of the supply, including whether it comprised transport, installation, site testing and commissioning, and in particular whether this took place at a substation in operation; and finally the recency of the reference, where the most recent supplies carry the greatest weight among otherwise equally relevant references.
